Supreme Court Helps the Euro Court
The Supreme Court of Russia has written a draft law “On Compensation by the State for Harm Caused to a Citizen by the Violation of Reasonable Deadlines for the Consideration of Cases and the Non-Enforcement of Judicial Acts that Have Entered Legal Force.” Chairman of the court Vyacheslav Lebedev stated when he announced the law at the Council of Judges of Russia meeting in Moscow yesterday that it should reduce the flood of cases being filed by Russian citizens with the European Court.
The European Court has repeatedly recommended the passage of such a law. The draft has already been sent to the European Court for examination and may be submitted to the State Duma next month.

The draft law does not specify amount of compensation. Every case would be considered individually. The passage of the law will not be an obstacle to Russian citizens to appeal to the European Court, however, according to Lebedev. Yuly Shmidt, chairman of the Russian Committee of Lawyers in Defense of Human Rights, doubts that, but acknowledges that “It will be better for our people, of course, if such a law is passed, but only there is a genuinely effective mechanism in it for recovering funds from the state.”
