Germany to Pay for Bashkir Aircraft
The Court of Constance, Baden-Württemberg, Germany, ruled on the suit of Bashkir Airlines yesterday. In substance, the award blamed on German government the air crash that killed 71 people and enforced the remedy of ˆ2.6 million.
That tragic night of July 1-2, 2002, Bashkir Tu-154 was en route from Moscow to Barcelona. It flew into the cargo Boeing B757-200 of DHL that was heading for Brussels, and the crash killed two pilots of Boeing and 69 passengers and crew members of Russia’s plane, including 57 teenagers from Bashkortostan, Moscow and Vladikavkaz.
The tragedy happened in the air area of Germany, on the Swiss border near the town of Uberlingen. The investigation revealed that two states failed to provide the adequate air control there. Germany committed Swiss Skyguide to supervise traffic over the southern area but didn't ensure the safety of frontier zone, Bashkir Airlines claimed. Moreover, by passing control to a foreign firm, Germany took responsibility for Skyguide.
The Court of Constance upheld Bashkir Airlines yesterday, making Germany accountable for the air crash despite the control transfer.
