Putin Seals Intellectual Protection Act
Russia’s President Vladimir Putin sealed the Section 4 of the RF Civil Code that relates to results of the intellectual property and the means of individualization. Putin also signed the Federal Act on Putting in Force Section 4 of the RF Civil Code, president’s news service reported.
Among other things, the Section 4 of the RF Civil Code specifies intellectual activities to be protected by law. The list sets forth the work of science, literature and art, production secrets, discoveries, industrial samples and prototypes, brands, software, databases and so forth.
The act spells out the right of the author, including the excusive right, for operating results or, at discretion, for means of individualization. It also authorizes to restrict the exclusive right, including with no consent of the right holder, who will retain the right for remuneration in any case.
Moreover, the act says that the results of intellectual activities could be used only under the contracts on alienation of the exclusive right or the license contract. Of interest is that no contract will be deemed concluded if it fails to specify remuneration or procedures to determine it.
