Yukos Paid 90bn in Excess to Budget
Bankrupt Yukos paid over 90 billion rubles in excess to the budget, RIA Novosti reported Friday with reference to the article in Vedomosti newspaper.
“The court has determined its standing in respect of tax fines. Tax officers may double the fines provided the taxpayer has again violated the law after being made accountable for similar wrongdoing,” Vedomosti wrote after studying the resolution of Supreme Arbitration Court passed for Priobie bank.

But should this resolution be applied to the Yukos case, it appears that imposing double fines on it hadn’t been quite in line with the law, said the lawyers, whom Vedomosti approached for comment.

In 2004, tax officers presented to Yukos tax claims for four years at once. The fines of 2001 through 2003 totaled 180.5 billion rubles. The amount was twice as much due to repeated wrongdoing. But Yukos hadn’t been brought to account between the inspections reports, so there was no reason for the double fines.

Therefore, Yukos paid 90.2 billion rubles in excess to the budget. Some time ago, Yukos receiver Eduard Rebgun declared he cleared accounts with creditors but lacked 76 billion rubles to meet all claims.

Getting back the money would be impossible, the lawyers are sure. Yukos was liquidated as an entity, the bankruptcy was completed and the lack of money was written off as bad debt.
